General Rental Conditions Rev. 01.05.04 Terms & Conditions
1. The vehicle may be driven only by the authorised HIRER or
other persons here indicated, and provided that such persons be at least 25
years old and signed a FARGO VEHICLE HIRE
hire agreement. (21-24 years old may drive up to a 1.4 car and
standard size commercial vehicle e.g Transit not 3.5 ton),and have held a full
driving licence for a minimum of 2 years and under the age of 75. (over 8 seats
minimum age of 25).
. The rental period must not exceed 30 days for any one agreement.
2a The hirer agrees to keep the car locked at all times when
not in use .
3. The hirer can NEVER SELL THE VEHICLE, its equipment or
tools. Any infractions of these undertakings empower the Lessor to demand the
return of the vehicle immediately without being required to justify
such action or make payment whatsoever.
4. The hirer undertakes that the vehicle will NOT be used: a)
to push or tow any other vehicles, trailer or any other rolling
objects . b) in races or any competition .
c) by anyone under the influence of drugs or alcohol . d)
for illegal purpose of carriage of goods . e) to carry more
passengers than the vehicle permits. In the event of any accident, the HIRER is
liable for any damage to the FARGO VEHICLE HIRE vehicle and any third party
involved..
The hirer also agrees that the vehicle be returned in the same condition as of
hire. In the event of damage being occasioned to the vehicle and rendered
unusable, the hirer will be responsible until such time as the vehicle is
returned in the original condition of hire.
5. The hirer acknowledges the rented vehicle is in good
condition and that all tyres are without punctures. In the event of any one of
them being damaged by any use other than normal wear and tear, the hirer agrees
to replace the same forthwith at his/her expense with tyres of the same
dimension and in equivalent state of wear.
6. The trip recorders and connectors are sealed but if tampered
with the Lessor will be paid on the basis 200 miles per day independently of
prosecution for fraudulent use.
7. The rental and payments are determined by the appropriate
rate lists and are payable in advance.(Payment to be made by credit/debit card.
American Express will be charged an additional £1.50 surcharge.)
8. The hirer remains solely liable for traffic fines, reports
and official statements drawn against him/herself.
9. The hirer will be automatically held
responsible for any accident that occurs if he/she disregards any traffic
regulation (the highway code). The immobilisation of the vehicle is stipulated
by the ordinary tariff of the car per day, the days that the car is in repair.
-Insurance only drivers approved by FARGO VEHICLE HIRE are entitled to the
status of being insured. THE HIRER MUST ALWAYS PROTECT the interest of the
Lessor.
-Report to FARGO VEHICLE HIRE any accident, fine or theft with immediate effect,
to include in the report circumstances, dates, places, all details etc.
-There is no insurance coverage for any driver not holding a valid driving
licence and not named on the contract.
-Carried clothing or articles are not covered.
-The car is insured only for the length of the rental stated on the agreement .
-Damage to the vehicle resulting from poor and uneven roads is on the clients
account.
-FARGO VEHICLE HIRE declines all responsibility for injuries to third parties or
damage to the vehicle which the Hirer may cause during the rental
period if he/she has wilfully supplied FARGO VEHICLE HIRE with false information
as to his/her identity, address etc.
-There is no insurance cover for car accessories e.g radio.
-Insurance does not cover for loss, theft or damage to any property transported
in the vehicle.
10. Late delivery of the vehicle. More than one hour lapsed an
additional complete days hire will be charged. Loss of vehicle keys; the hirer
will be charged £75.00 + VAT.
The client is liable to pay any expenses concerning delivery of spare keys and
papers.
11 . Any fines for traffic offences,congestion charges, etc are
the hirers own responsibility. Any intervention by FARGO VEHICLE HIRE where
payment is necessary, the hirer will be charged this cost plus an additional
administration fee of £25.00 + VAT.
12 . THE HIRER must pay any costs of recovering the vehicle in
the event that you fail to return the vehicle to us as required.
13. 7.5 ton vehicles only . The hirer must acknowledge that
these vehicles are not used for trade or business purposes. Private use of
these vehicles is permitted only.
EXCLUSIONS
In the event of any accident caused by the fault of the HIRER, towing charges
and repairs will be arranged by FARGO VEHICLE HIRE and charged to the HIRER
accordingly.
Fuel is entirely at the clients expense. If on return of vehicle there is a fuel
shortage, the client will be charged additionally, at £1.05 per litre to
compensate loss. The client must be responsible for checking oil & water
level. Punctures are at the clients expense.
Maintenance and repair:- Normal mechanical wear is on the account of FARGO
VEHICLE HIRE. Repairs may be made only with the written consent and according
with the instructions of FARGO VEHICLE HIRE if the repair is accepted by FARGO
VEHICLE HIRE.
Conditions of the contract:- No amendment of terms and conditions of this
contract are valid unless produced in writing.
Applicable Law:- the present contract will be registered according to English
Laws. Hirer will be charged £750.00 + vat excess for damage to vehicle, unless
otherwise stated on Hire Agreement.
